According to regulations, the responsibility for obtaining and paying for the energy certificate lies with the owner of the building. In an apartment building, the energy certificate is provided by the housing association, not by the apartment owner. Given by the property manager of the housing company (or the chairman of the board) or by an authorized separate energy certificate provider.

The energy certificate is always prepared by a person who has obtained the qualification as an energy certificate provider. The issuer of the energy certificate must be registered in the registry for energy certificate issuers (supervised by ARA, the governing body for energy certificates and their issuers), and they must meet the general requirements for conducting their operations.

The building’s energy efficiency is primarily a question of the efficiency of the building’s structural parts and technical
systems in total energy consumption, including purchased energy.

1) exterior walls, exterior doors, windows, upper and lower floors and other structures;
2) heating system;
3) A Domestic Hot Water (DHW) system
4) ventilation and air conditioning system;
5) lighting;
6) cooling system;
7) electric separate heating;
8) other systems affecting the energy efficiency of the building.
The purchasing power and consumption habits of residents are also taken into account.

The energy certificate applies to new buildings (the certificate must be presented when applying for a building permit), residential apartment buildings, and single-family houses for sale
or rent, built on or after January 1, 1980, as well as rental single-family houses consisting of three or more residential units and
row houses or townhouses built on or after January 1, 1980.

NOTE The energy certificate must be presented during sales and rental situations. The purchase of the energy certificate is the responsibility of the seller or lessor. The energy certificate describes the energy efficiency of the house, but it also contains information on the actual energy consumption. The energy certificate must be present in the sales or rental presentation.

In the energy performance certificate, buildings are classified into energy efficiency classes A-G according to their energy rating. The E-number is based on the building’s calculated consumption and
energy form factors. The best is energy efficiency class A.

According to Section 17 of the Act, the person responsible for obtaining an energy certificate may, if he so wishes, obtain a certificate in accordance with the lighter energy certificate procedure if the value of the building or real estate or apartment to be sold or the right to occupy it in a residential building comprising no more than two residential apartments is very low or if there are other particularly justified reasons, such as sale or rental between close relatives, for using the lighter procedure.

According to the Government Decree (170/2013), the above-mentioned value can be considered very low if the selling price is less than EUR 50,000. 339 / 1000 In addition to sales or rentals between close relatives, the lighter procedure may also be used for other special reasons if the building, real estate or apartment to be sold or rented is not publicly displayed for sale or rental, nor is it offered for sale or rent through publicly displayed advertising. The lighter procedure can also be used if the rent of a building, property or apartment is less than EUR 350 per month.

According to the Ministry of the Environment Regulation on building energy certificates, when using the simplified energy certificate procedure in a publicly displayed advertisement for sale or rental, instead of using a symbol representing the building’s energy efficiency, use the symbol H.
